Information under the EU Data Act
The LocoGPS L2 is a connected product, and the LocoGPS app with its subscription is the related service within the meaning of Regulation (EU) 2023/2854 (Data Act). Before you buy the tracker or take out a subscription, we inform you here which data is generated, how long we store it and how you can access it, share it or erase it.
1. Which data the tracker generates
The tracker generates the following data and sends it to our server over the mobile network.
- Location with latitude and longitude, altitude, speed, heading, time and number of satellites received
- Wi-Fi networks nearby (device identifier and signal strength, and the network name when searching for your home Wi-Fi) and mobile network cells (identifier and signal strength), so that the tracker can be located even without GPS reception
- Battery level, charging state, steps and motion state
- Notices and alarms, for example when the battery is low
- Technical information such as mobile signal strength, the identifier of the built-in SIM card and the device status
Using the app also generates data of the related service, for example your geofences and Wi-Fi zones, settings, notifications, the detected activities and your corrections to them.
The data is generated in a technical format of the manufacturer and stored in a database on our server. In the app you see it prepared as a map, history and activities. At the standard interval of 2 minutes this amounts to about 720 location reports per day, together well under one megabyte.
2. How often the data is generated
The tracker reports at the interval you choose in the app, between once a minute and once a day, and hourly in deep sleep. In live mode it reports every 5 seconds for 3 minutes, and during a walk every 10 seconds for at most 2 hours. In an energy saving zone it reports less often. The data is transmitted continuously and almost in real time. Without mobile reception the tracker briefly buffers locations and sends them as soon as it has a network again.
3. Where and how long the data is stored
The tracker itself only holds buffered locations until the next transmission and your settings, for example up to three Wi-Fi energy saving zones. On our server in Germany we store locations and events for 365 days, after which they are deleted automatically. We delete technical logs after 90 days at the latest. How long data may remain in backup copies is described in our privacy policy.
4. How you access your data
In the app you see the current location, the history of the last 365 days and your activities. In History you download the data of a period yourself, free of charge and at any time. You can choose between “CSV with all tracker data” (every position with time, coordinates, speed, battery level and all other values the tracker sent), GPX and KML. We will send you all data of your trackers at once, including the data of the related service, on request to support@locogps.de, free of charge and without undue delay, in a commonly used machine-readable format. With the LocoGPS integration for Home Assistant you can also transfer the data continuously into your own system.
5. How you erase data
With “Delete Device” in the app you remove a tracker together with its entire location history, and with “Delete Account” your account with all associated data. We delete individual periods on request to support@locogps.de.
6. Who receives the data and for what purpose
The data holder is LocoGPS. We use the data to provide the service, that is for locating, history, activities, geofences, notifications and energy saving. We also analyse location and device data to find errors and to improve features such as the detection of walks and the battery life. We do not sell data and do not pass it on for advertising.
Some service providers receive data where this is necessary for the service. Our hosting provider stores the data in Germany. A mobile network service provider based in Germany provides the SIM card and sees the connection data. Google receives Wi-Fi identifiers and mobile network cells to calculate a location from them when there is no GPS reception. LocationIQ receives coordinates when you have an address displayed. Google Firebase delivers push notifications. Payment service providers such as Stripe and PayPal process the payment and receive no location data. Details and transfers to third countries are described in our privacy policy.
7. Sharing with third parties at your request
You can request that we share your data with a third party of your choice. Write to support@locogps.de and we will get back to you without undue delay.
8. Data holder and contact
LocoGPS
Marienhook 28, 48691 Vreden, Germany
support@locogps.de, in the app under Help
Full details of the provider are given in the imprint.
9. Complaints
If you believe that we are infringing your rights under the Data Act, you can lodge a complaint with the competent authority. In Germany this is the Federal Network Agency (Bundesnetzagentur, www.bundesnetzagentur.de). For questions on the protection of personal data it involves the Federal Commissioner for Data Protection and Freedom of Information, who is responsible for companies in this respect. Your right to lodge a complaint with a data protection supervisory authority under the General Data Protection Regulation remains unaffected, see our privacy policy.
10. Trade secrets
The data of your tracker does not contain any trade secrets that we withhold from you.
11. Duration and end of the contract
The subscription starts with a free trial month of 30 days. The monthly plan can be cancelled monthly. The annual and 2-year plans then continue as a monthly plan that can be cancelled monthly unless you actively renew. You can cancel in the app, via “Cancel contracts here” or by email. After the subscription ends, our server no longer accepts new data from the tracker. The data stored until then remains available in the app until it is deleted after 365 days or you delete the device or account.
